At KWANZOO Inc., we provide Software to you, the Licensee, as defined in, and under the terms stated in the Kwanzoo Software License Agreement with any amendments thereof (the “Agreement”). Capitalized terms used but not defined in this Privacy Policy have the meanings set forth in the Kwanzoo Software License Agreement. We may access certain Licensee Data as we provide our services to you. We respect your need as well as the need of Licensee data subjects’ for online privacy and we protect any information that you may share with us, in an appropriate manner. Our practice as regards use of your and your Licensee data subjects’ information is as set forth below in this Privacy Statement and the Kwanzoo GDPR Privacy Addendum and the Kwanzoo CCPA Addendum (together with the “Kwanzoo Privacy Policy”). As a condition to use of our services, you consent to the terms of the Kwanzoo Privacy Policy as it may be updated from time to time. In the event of a material change, we shall notify you via email or by means of a prominent notice on the web site.

This Privacy Statement applies exclusively to www.kwanzoo.com and all website visitor tracking and ad serving through ads.kwanzoo.com. It additionally applies to all other capabilities of the Software as made available to you under an active Agreement. Our Software 
de-anonymizes a portion of your website traffic where we identify individual website visitors with their full contact information. To deliver this capability, Kwanzoo sells and/or shares the personally-identifiable (PII) information of these website visitors to you. Kwanzoo additionally provides their behavioral data both on and off your website to you.
 
Kwanzoo receives your PII de-anonymized website visitor data from our third party data partners, who maintain such PII data in compliance with data privacy laws including the California Consumer Privacy Act (CCPA). We may additionally enrich the data using other data provider partners, to improve the quality and accuracy of the data. We may additionally process the website information and map it to media targeting cookies, for the purpose of serving targeted advertising to such identified website visitors.
 
Your access and use of all such de-anonymized website visitor information, provided by Kwanzoo requires an active subscription for the Software (unless the website visitor has directly engaged with you, prior to the termination of your use of the Software).
 
Information Recorded and Used:
 
1. Personal Information
a. During the Registration Process for creating a Kwanzoo Account, or through certain forms on the website, we may request your name, email address and other personally identifiable information. You will also be asked to choose a unique username and a password, which will be used solely for the purpose of providing access to your Kwanzoo Account. Your name and email address will be used to inform you regarding new services, releases, upcoming events and changes in this privacy policy. When you elect to register an account, you may also have the option to create an account by using your Yahoo, Facebook, Twitter or Gmail login information -third party platforms. In doing so, no personal information within your third-party email or social platform accounts is transferred to your Kwanzoo account without your explicit consent and is provided as a convenience to you.

b. When users set up a Kwanzoo Account, we may provide them with the opportunity across our various service offerings to include third party personal information within their contacts and databases. This information may include third party names, email, phone numbers and physical addresses. This information is used for servicing user requirements as expressed by users to Kwanzoo and solely as part and parcel of the service and license to the Software. We do not share any third-party personal information (Licensee data subjects) shared with Kwanzoo by the user, with any other user for promotional purposes, nor does Kwanzoo utilize it for any purposes not expressly consented to by the user.

c. When you elect to refer friends, co-workers or industry colleagues to the web site to access and use the Software, we request their email address and name to facilitate the request and deliver emails to facilitate your referral request.

d. We post user testimonials on the Site. These testimonials may include specific names, and we acquire permission from our users prior to posting these on the Site. Kwanzoo is not responsible for the personal information users elect to post within their testimonials.

2. Account Usage Details

e. Your Account Usage Details such as time, frequency, duration and pattern of use, features used, and the amount of storage used will be recorded by us in order to enhance your experience of the services and to help us provide you the best possible experience with the Software.

3. Contents of your Account

f. We store and maintain images, files, email contact lists, physical address contact lists, target account lists, job title lists and other data in your Account at our facilities in the United States or any other country. Use of Kwanzoo Services signifies your consent to such transfer of your data outside of your country. In order to prevent loss of data due to errors or system failures, we also keep backup copies of data including the contents of your Account. Hence your files and data may remain on our servers even after deletion or termination of your Account. We assure you that the contents of your Account will not be disclosed to anyone and will not be accessible to employees or consultants of Kwanzoo in this capacity.

4. Financial Information

g. In case of services requiring payment, we request credit card or other payment Account information, which will be used solely for processing payments. Your Financial Information will not be stored by us except for the name and address of the card holder and the last four digits of the Credit Card number. Subject to your prior consent and where necessary for processing future payments, your Financial Information will be stored in SSL(secure socket layer) encrypted form on secure servers of our reputed Payment Gateway Service Provider who is beholden to treating your sensitive information in accordance with this privacy statement.

5. Visitor Details

h. We use the Internet Protocol address, browser type, browser language, referring URL, files accessed, errors generated, time zone, operating system, first party and third party cookie information, and other visitor details collected in our log files to analyze website visit and ad serving patterns, improve personalization capabilities, analyze non-personally identifiable, aggregate details and trends across segments of site visits or ads served, administer the Kwanzoo website, track visitor's movements on our ads and across your website, our website and the Kwanzoo Software platform, and to improve our platform.

6. Cookies

i. We use temporary and permanent cookies to enhance your experience of our services. Temporary cookies will be removed from your computer each time you close your browser. By selecting 'keep me signed-in' option in Kwanzoo services, a permanent cookie will be stored in your computer and you will not be required to sign-in by providing complete login information each time you return to our website. If you have turned cookies off, you may not be able to use registered areas of the Kwanzoo website or the platform. We tie cookie information to your email address when you elect to remain logged in so as to maintain and recall your preferences within the Site. We may from time to time employ the use of pixel tags or website visitor tracking tag generated by the platform, on our site, on your own(ed) website(s), on other advertiser websites, and in advertiser emails. Pixel tags such as web beacons are 1x1 images that are embedded onto a web page to document traffic, analyze visitor behavior, visitor interactions with content, and ad analytics without collecting any personal information.

j. We may from time to time employ the services of a third party agent to analyze statistical and aggregate data about our platform content and user base, or test the validity and quality of third party data used by our platform during website visitor tracking on your website, or ad serving. This aggregated information, and any information provided to such third party agents for the explicit purposes stated herein is not personally identifiable, and is employed to improve data quality, in improving platform functionality and solution offerings. To this end, these third parties may employ the use of cookies and, or pixel tags, or analyze the website visitor’s first party and third party cookies, on our website as well as yours, in providing their services.

7. Links from our website

k. Some pages of our websites contain external links. You are advised to verify the privacy practices of such other websites. We are not responsible for the manner of use or misuse of information made available by you at such other websites. We encourage you not to provide Personal Information, without assuring yourselves of the privacy policy of other websites.

8. With whom we share Information

l. We will obtain your prior specific consent before we share or disclose your personal information, or the personally identifiable Licensee data that you provide to us, to any person outside Kwanzoo. We may share generic aggregated demographic and firmographic information regarding visitors and users we support and serve with our business partners. Please be aware that as a Cloud-Based Technology Service Provider, laws in various jurisdictions in which we operate may obligate us to disclose user information and the contents of the Accounts to the local law enforcement authorities under specifically defined circumstances such as when complying with a formal request in a civil suit, court order, or subpoena. We reserve the right to disclose information to our services providers -to the extent necessary for them to provide their services- as well as law enforcement where necessary for protecting the safety of our users, employees, or the general public as we deem appropriate in our sole and absolute discretion.

9. How secure is your Information

m. We adopt industry appropriate data collection, storage and processing practices and security measures, as well as physical security measures to protect against unauthorized access, alteration, disclosure or destruction of your Personal Information, username, password, transaction information and data stored in your Account. Access to your name and email address is restricted to our employees or consultants who need to know such information in connection with our services and are bound by confidentiality obligations.

10. Your Choice in Information Use

n. You will be required to register for our services by providing Personal Information. If you choose not to provide your Personal Information, we will be unable to provide you the services. We do provide you with the option of resetting your own password; however, we may not be able to reset your password for you. We also provide you with the option of opting out from receiving email from us; however, you will not be able to receive email notifications of new services, releases, upcoming events and changes to the Kwanzoo Privacy Policy should you decide to opt-out of receiving all messages from Kwanzoo. In the event we decide to use your Personal Information for any purpose other than as stated in this Privacy Policy, we will offer you an effective way to opt out of the use of your Personal Information for those other purposes. You may opt out of receiving newsletters and other secondary messages from Kwanzoo by selecting the 'unsubscribe' function present in every message we send out.

11. Accessing, Updating and Removing Personal Information

o. We provide users with access to their personal information. Users may correct, update or remove any such personal information either by accessing their Kwanzoo Account, or by accessing the Do Not Share or Sell My Personal Information form on the Kwanzoo website, or by contacting Kwanzoo Customer Success services. Such changes may take up to 48 hours to take effect. We will respond to all enquiries within 30 days.

12. Enforcement of Privacy Policy

p. We make every effort, including periodic reviews to ensure that Personal Information provided by you is used in conformity with this privacy policy. If you have any concerns regarding our adherence to this policy or the manner in which Personal Information is used for the purpose of providing the services, kindly contact Kwanzoo Customer Support services at customersuccess@Kwanzoo.com. We will contact you to address your concerns and we will also co-operate with regulatory authorities in this regard if needed.

13. Notification of Changes

q. Any changes to the Kwanzoo Privacy Policy will be posted on our websites in order to keep you informed of any changes in nature of information collected, manner of collection, use and sharing of information. If at any point we decide to use personal information in a manner different from that stated at the time it was collected, we will notify you by email and provide you with the ability to opt out of these new uses unless you have opted out from receiving all email notifications from us. You will not receive email notification of minor changes to the Kwanzoo Privacy Policy. If you are concerned about how your information is used, you should check back at periodically.
